Terms of Service

1. Acceptance of Terms

By accessing or using LuckyMaid, operated by Birchard Capital LLC ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

LuckyMaid is a cloud-based customer relationship management platform designed for cleaning businesses. The Service includes features for managing clients, scheduling jobs, tracking finances, generating invoices, accepting online payments, sending automated communications, and integrating with third-party services.

3. User Accounts

To use the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Providing accurate and complete information

4. Subscription and Billing

Access to LuckyMaid is provided through a paid subscription plan:

4.1 Free Trial

New accounts receive a 14-day free trial with full access to all features. No payment is required during the trial period. At the end of the trial, you must subscribe to continue using the Service.

4.2 Subscription Fees

Subscription fees are billed monthly. The current pricing is displayed on our website and during the signup process. We reserve the right to change pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

4.3 Payment Processing

Subscription payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. All fees are non-refundable except as expressly set forth in these Terms.

4.4 Cancellation

You may cancel your subscription at any time through the Billing section in Settings or by contacting us. Upon cancellation, you will retain access to the Service through the end of your current billing period. After that, your account will be placed in read-only mode — you can view your data but cannot create or modify records.

4.5 Failed Payments

If a payment fails, we will attempt to process the payment again and notify you by email. If payment is not resolved within 14 days, your account may be placed in restricted mode until payment is updated.

5. Payment Processing for Your Clients

The Service allows you to accept payments from your clients via Stripe Connect and/or Square. By using these features, you agree to:

  • The additional terms of service of your chosen payment provider (Stripe or Square)
  • Comply with all applicable laws regarding payment processing, including PCI-DSS requirements
  • Accept responsibility for disputes, chargebacks, and refunds between you and your clients
  • Understand that LuckyMaid does not hold, process, or store your clients' payment card data directly — all payment data is handled by the payment provider

LuckyMaid is not a party to the payment transactions between you and your clients. We provide the tools to facilitate payments but are not responsible for payment disputes, failed transactions, or chargebacks.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Upload malicious code or content
  • Use the Service to send unsolicited bulk communications (spam)

7. Your Data

You retain ownership of all data you enter into the Service. By using the Service, you grant us a license to host, store, and process your data solely for the purpose of providing the Service.

You are responsible for ensuring you have the right to enter any personal data about your clients and employees into the system, and for complying with applicable privacy laws.

Upon account cancellation, your data will be retained in read-only mode for at least 90 days. You may request a full export or deletion of your data by contacting us.

8. SMS/Text Messaging Terms

LuckyMaid offers SMS text messaging as part of its service communications. By providing your phone number and consenting to receive text messages, you agree to the following terms:

8.1 Message Types

You may receive the following types of SMS messages from LuckyMaid:

  • Booking confirmations and appointment details
  • Appointment reminders (e.g., night-before reminders)
  • Service completion notifications and payment requests
  • Scheduling updates and changes
  • Quote delivery notifications

8.2 Consent

By providing your mobile phone number and opting in, you consent to receive SMS messages from LuckyMaid related to your cleaning service appointments. Consent to receive text messages is not a condition of purchasing any goods or services. You may opt in through our website booking form, by phone when scheduling a service, or in person.

8.3 Message Frequency

Message frequency varies based on your service activity. You will typically receive 2 to 5 messages per service booking (confirmation, reminder, completion notice, and payment notification).

8.4 Opt-Out

You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message. You may also opt out by emailing tidycocleaners@gmail.com with the subject line "SMS Opt-Out" and your phone number.

8.5 Help

For help with SMS messaging, reply HELP to any message or email tidycocleaners@gmail.com.

8.6 Carrier Fees

Message and data rates may apply. LuckyMaid does not charge for SMS messages, but your mobile carrier may charge standard messaging and data fees. Please contact your carrier for details about your messaging plan.

8.7 Phone Number Privacy

We do not sell, rent, or share your phone number or SMS opt-in data with third parties for marketing purposes. Phone numbers are used solely for sending service-related communications as described above. For full details on how we handle your data, see our Privacy Policy.

9. Third-Party Integrations

The Service may integrate with third-party services including Google Calendar, Stripe, Square, Twilio (SMS), and Resend (email). Your use of these integrations is subject to the terms and privacy policies of those third parties. We are not responsible for the practices of third-party services.

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

11. Limitation of Liability

To the maximum extent permitted by law, Birchard Capital LLC (operating as LuckyMaid) and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. This includes but is not limited to damages arising from payment processing failures, missed notifications, scheduling errors, or third-party service outages.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may cancel your subscription and terminate your account at any time through the Billing section in Settings or by contacting us. Upon termination, your data will be retained in read-only mode for at least 90 days, after which it may be permanently deleted.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes by email and by posting a notice on the Service at least 30 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the modified terms.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
